1. In these Conditions, “we”, “us”, “our” or “UK Cobra Club” means Cobra Replica Club UK Limited. When we refer to UK Cobra Club this includes the website located at www.ukcobraclub.co.uk (“UK Cobra Club Website”), and all other UK Cobra Club platforms including mobile and tablet.
2. By accessing or using this Site or otherwise indicating your consent, you agree to be legally bound by these Terms and the documents referred to therein.
3. If you do not agree with or accept any of these Terms, you should stop using the Site immediately.
4. If in the opinion of UK Cobra Club any Classified Advertisement is misleading it may be altered or deleted without notice.
5. All Classified Advertisements will be removed from the website after one calendar month.
6. Any error in Classified Advertisements can be rectified free of charge upon notification by the seller.
7. No responsibility is accepted by UK Cobra Club for the condition of any vehicle or parts advertised, or the bona fides of any buyer or seller introduced or the temporary suspension in advertisements service as a result of circumstances beyond the reasonable control of Classified Search. Responsibility for either Direct and/or Consequential losses of any kind, howsoever caused, are specifically excluded by Cobra Replica Club UK Ltd.
8. For non-members of UK Cobra Club, no monies paid for advertising shall be refunded should the Classified Advertisement fail to attract a response leading to the sale of the vehicle.
9. Should a vehicle be damaged or stolen after placing a Classified Advertisement with UK Cobra Club and becomes unsaleable, no monies paid for advertising will be refunded by UK Cobra Club.
10. UK Cobra Club take every reasonable care in provision of this Classified Advertisement service but, no guarantee is given to the accuracy or completeness of anything contained in this site. It is the full responsibility of the Prospective buyers of vehicles to check with the vehicle owners that the details and particulars of the vehicles are correct.
11. These terms and conditions were correct at time of writing but are subject to change without notice.
12. Nothing contained in the above terms and conditions is intended to affect, nor will affect your statutory rights.
13. The UK Cobra Club only provide a platform for a Seller to list their Private Sale Vehicle or Component Parts for Sale, we are not in any way involved in the contracting process nor are we in any way party to the sale contract between the Buyer and the Seller. We do not hold title of any Vehicle, inspect any Vehicle, or have any Vehicle in our legal possession.
14. As a Seller, you warrant and represent that you have legal ownership of the Classified Vehicle or Component Parts.
15. UK Cobra Club only provides the platform for a Seller to list a Classified Vehicle and a Buyer to express its interest in a Classified Vehicle.
16. UK Cobra Club Classified Advertisements are not available to Trade Sellers.
17. By placing a Classified Advertisement on the UK Cobra Club Site, the Seller is deemed to have accepted these Terms together with all other policies, Terms and Conditions that may be posted on the Site from time to time.
18. By making an enquiry into a Classified Advertisement on the UK Cobra Club Site, the Buyer is deemed to have accepted these Terms, together with all other policies, Terms and Conditions that may be posted on the Site from time to time.
19. If you are a Buyer making an offer to the Seller for a Classified Vehicle, you acknowledge that it is your responsibility to:

 19.1.     Review the Classified Vehicle’s listing description, photographs and information provided in relation to the Classified Vehicle by or on behalf of the Seller in the comments section.

 19.2.     Conduct your own due diligence on the Classified Vehicle, including any vehicle database checks, (including HPI and Insurance Write off Checks) before purchase;

 19.3.     Arrange an inspection of the Classified Vehicle before purchase;

 19.4.     Check the Classified Vehicle at the point of collection;

 19.5. Independently determine the description, ownership, value, condition, authenticity, quality of the Classified Vehicle and any additional fees connected to the purchase such as government fees and taxes, title and registration fees, licensing and plate fees, finance charges dealer document preparation and emissions testing.

20. The Seller is solely responsible for the factual accuracy of, and for any opinions expressed in, the description of a Classified Vehicle, and for any error, misstatement or omission of information in that description, as well as the condition, authenticity and quality of the Classified Vehicle. UK Cobra Club cannot accept any responsibility whatsoever for the accuracy of such information.
21. The Seller must provide a method for prospective Buyers to be able to communicate with the Seller, the UK Cobra Club will not facilitate any communication between the Seller and Buyer
22. It is the responsibility of a Buyer and Seller, respectively, to negotiate the terms of a binding transaction and enter into a sale contract for a Classified Vehicle.
23. It is for the Buyer and Seller to agree a suitable payment method for the Classified Vehicle.
24. UK Cobra Club is not a party to any transaction between Buyers and Sellers. UK Cobra Club provides no conditions, representations or warranties of any kind, either express or implied. Any communications and transactions that may arise from a Classified shall involve only the Seller and a prospective Buyer and UK Cobra Club shall have no obligation or responsibility whatsoever to either the Buyer, Seller or any other party in respect of any Classified or the sale of a Classified Vehicle.
25. The description of the Classified Vehicle and/or is, to the best of the Seller’s knowledge, accurate and not misleading.
26. To the extent permitted by laws f England and Wales, UK Cobra Club has no duty to the Seller or the Buyer to investigate the accuracy of the description of any Auction Lot, Classified Vehicle or Private Sale Vehicle provided by or on behalf of the Seller.
27. The Seller is solely responsible for the content of the photographs provided in connection with their listing of a Classified Vehicle or Component Part. UK Cobra Club is not responsible for checking or verifying the content of the photographs or for deleting any sensitive information contained in them.
28. Photographs and illustrations used for a Classified Vehicle or Component Part are for identification purposes only. They may not show the true condition and colour, (which may be inaccurately reproduced) of the Classified Vehicle or Component Part
29. Any dispute with respect to the sale of any Classified Vehicle or Component Part shall be resolved between the Buyer and Seller and without the participation of UK Cobra Club.
30. Ultimately, these Terms and Conditions shall be governed by the Laws of England and Wales
