Title: MOT and position lights question

A friend of mine has asked me this question, I haven't been able to find a definitive answer on line.

Do we have any MOT testers in the club who might know the real answer.

MOT on a cobra 2024, if your side lights do not turn on with your Ign off its an MOT fail ??.
As the side lights are classed as positioning lights.

Surely if your cobra has recently passed its IVA or within the last 3 or 4 years, with your side lights not coming on until turn on your Ign on, then it should still pass an MOT now, as it has not been modified or changed.

If true then every Ak cobra is going to fail.
Also they cant expect all cars to be retrospectively rewired for new rules.

They would have to expect all cars registered after the rule to comply.

 
Or does this mean all cobra`s needs to modified to make sure your side lights switch on without your IGN on, or is this normal, and some of us just got lucky at our IVA, but now need to make a mod to make sure they can be turned on with the Ign off.

This is a new on me.
